ROBERT G. HARKEN
Robert Harken is the founding member of the Harken Law Firm, LLC. Rob’s practice focuses on a variety of legal matters including appellate practice, business and contract litigation, discrimination and harassment, and employer/employee rights. Rob prides himself on being more than just an attorney, but a trusted partner. Rob is committed to helping his clients answer their legal questions and resolve their legal disputes in order for the clients to recover what is owed to them and obtain control over their business, work, and personal life. Rob possesses over 15 years of litigation and trial experience necessary to navigate the legal system and attain positive results for his clients. Rob has obtained numerous favorable settlements and judgments. Rob has litigated cases at both the trial court and appellate court levels, in Federal and State Court, and before the American Arbitration Association.
Rob began his career in November 2003 with a small law firm that serviced its clients located throughout the Kansas City metropolitan area. Rob represented clients in all facets of litigation, including divorces, modifications of parenting plans, drafting wills and trusts, contract disputes, and criminal defense. Between October 1, 2007, and December 3, 2018, Rob worked for a boutique law firm dealing primarily in complex commercial and contract litigation. During this time, Rob represented clients throughout the United States and obtained judgments or entered into settlement agreements recovering several million dollars from defendants who failed to honor their obligations owed to Rob’s clients under the clients’ contracts.
Record of Success
Based on his legal experience, Rob has worked with other attorneys and learned how to be adaptive and resourceful by effectively managing difficult and novel legal matters. Rob has been integral in obtaining successful outcomes for his clients:
Successfully researching and applying the public policy behind the Kansas Workers’ Compensation Act to establish new law in Kansas, which now prohibits employers from contractually limiting employees’ rights to assert workers’ compensation retaliation claims within the two-year statute of limitations. See Pfeifer v. Federal Express Corporation, 304 P.3d 1226 (Kan. 2013).
Ssuccessfully obtaining summary judgment in a breach of contract dispute for his client in the amount of $209,901 in Sussex County, New Jersey (Synertx, Inc. v. Valley View Rehab. & Health Care Center, LLC, Case No. SSX-L-31-17).
Overturning an order of summary judgment against his clients in which the Colorado Court of Appeals remanded the case back to the trial court with directions to enter a judgment in favor of his clients finding that they were the owners of certain mineral rights in Weld County, Colorado (see Yardley v. Kerr-McGee, et al., 17CA0990, (Colo. App. April 19, 2018).
Obtaining summary judgment finding that claims between a natural gas producer and a previously certified settlement class should be resolved in class-wide arbitration, which was affirmed on appeal (see EnCana Oil & Gas (USA), Inc. v. Miller, 405 P.3d 488 (Colo. App. 2017).
